Store Policy, Terms and Conditions

 

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS WEB SITE AS THEY OUTLINE OUR POLICY ON REFUNDS AND EXCHANGES.

 

Duroque has a NO REFUND policy; all sales are final. Duroque does not accept returns or exchanges except for in the case of faulty craftsmanship or for damage during shipping. Returns are not accepted without proper authorization.

Freight will not be refunded under any circumstances.

 

You are solely responsible for your selections, subject to the following exceptions:

  • Your order was damaged in transit;
  • Your order did not arrive;
  • As otherwise required by law.

 

Orders and Production:

Orders can be accepted in person, via email, Duroque Website, US Mail, other package delivery services or by fax.

 

PAYMENT TERMS

All orders must be paid full before shipping, either by credit card, bank wire, or via PayPal. DUROQUE DOES not accept COD.

Custom orders require a 50% deposit when placed, with the balance to be paid prior to shipping. Duroque, accepts major credit cards, checks, wire transfers (add 1.5% for Wire Transfers) and cash for payments. The remaining 50% (plus any additional charges or shipping costs) must be paid 5 days prior to shipping.

 

Rush orders

Rush orders (4-8 weeks lead time) require a 100% deposit when placed.

 

SPECIAL ORDERS

Estimated Time of Arrival: Duroque will do its best to assure your merchandise arrives within the estimated arrival period. However, since these estimated times or arrivals are based on industry averages, we cannot offer any monetary compensation for unforeseen delays. If a delay should occur, we will notify you.

 

Color/Finish: Duroque does its best to assure the product you receive matches your order. However, due to the uniqueness of some of our products, color, finish and dye lot may vary on each item. In addition, continual exposure to light and temperature changes can and will affect wear.

 

Assembly: Some merchandise may require assembly.

 

Grades of Goods & Project Placement of Interior Merchandise: The buyer agrees to release Duroque from any liability resulting from goods or merchandise purchased from Duroque and placed into environments where certain grade(s) are legally required and said goods or merchandise do not meet those requirements e.g. commercial grade requirements, industrial grade requirements, etc.

 

Warranty of Goods and Merchandise: Duroque does not imply or offer any warranty of goods or merchandise outside of the warranty offered by the manufacturer of said goods or merchandise. Duroque offers the same warranty on all goods or merchandise sold to the buyer as provided to Duroque from the manufacturer whereas limited or no warranty on goods or merchandise provided to Duroque is the same warranty that will be provided to the buyer. The buyer agrees that Duroque will not be held responsible should part or no part of said warranties be honored by the manufacturer.

 

Order cancellation

Orders canceled after 24 hours are subject to a cancellation and 35% restocking fee in addition to any shipping charges incurred as may apply.

 

SHIPPING

 

INSPECTING YOUR FURNITURE UPON DELIVERY

Make sure before you sign for your furniture that you have inspected it for damages or any defects in craftsmanship. By signing for your furniture you agree that your furniture arrived in new retail condition with no damages. If there are damages you must file a Damage Claim with the shipper immediately and contact DUROQUE Customer Service at 310.854.44.01. There will be no exceptions to this policy.

 

Damages & Claims

DUROQUE  is NOT responsible for freight damages.  All items are carefully inspected by our staff before shipping.  You or your receiving agent MUST INSPECT each item upon delivery, and any damages must be clearly noted on the carrier's bill of lading before the driver leaves your location.  If the damage is severe and you feel that it can not be easily fixed, please do not accept those specific pieces. Please contact us immediately so that we can help make sure that everything is taken care of promptly and thoroughly.  If damages are not noted at the time of delivery than we have no recourse with our carriers and no claims will be honored.

Knots, gouges, small cracks and nail holes are inherent characteristics of many of our wood products and do not constitute damage/defects, no claims will be considered for these characteristics.

 

 

NO REFUNDS, NO RETURNS. ALL PRODUCTS MUST BE EXAMINED UPON DELIVERY BEFORE ACCEPTING THE PRODUCT.

ALL DAMAGES DUE TO SHIPPING MUST BE FILED WITH THE FREIGHT COMPANY BY THE PURCHASER AT THE TIME OF DELIVERY.

 

STORAGE

Duroque will charge storage fees for any order not shipped within 1 week of ESD because of non-payment of balances due or to delays caused by Customer arranged shipping. Charges will be calculated at 10% of the order total per month, or any portion thereof.

 

What law is applied to this Policy?

The laws of the State of California will govern and construe these Policies without giving effect to any conflict of laws provision to the contrary. By use of this website, you irrevocably consent for any reason and all disputes with Duroque to exclusive jurisdiction of the courts located within the county of Los Angeles, California to resolve any such legal matter. Notwithstanding this, you agree that Duroque com shall still be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.

 

How and where are disputes resolved?

Notwithstanding the preceding provision, but without limiting Duroque’s right to seek injunctive or other equitable relief in any court of competent jurisdiction, any disputes arising with respect to this agreement shall be referred to an arbitrator affiliated with JAMS. The arbitrator shall be selected by joint agreement of the parties. In the event the parties cannot agree on an arbitrator within thirty (30) days of the initiating party providing the other party with written notice that it plans to seek arbitration, the parties shall each select an arbitrator affiliated with JAMS, who shall jointly select a third arbitrator to resolve the dispute. The written decision of the arbitrator shall be final and binding on the parties. The arbitration proceeding shall be carried on and heard in Los Angeles, California using the English language and pursuant to the rules of JAMS. In any action or proceeding to enforce rights under these Terms or Use, the prevailing party will be entitled to recover costs and attorneys’ fees.

 

When is the effective date of these policies, and what about future modifications?

These Policies effective as of May 1, 2013. Duroque reserves the right to make changes, deletions, modifications, or provide supplements to this policy from time to time. Changes will apply to the information collected after the date of changes as well as to existing information held by us and will take effect immediately upon publication, unless otherwise stated in writing by Duroque. You agree that the express acceptance by you, or your continued use of the Duroque website after publication of changes, shall constitute your acceptance of these Policies.
